US companies are obliged to disclose personal data to security authorities without you as the data subject being able to take legal action against this. We hereby object to the use of contact data published as part of our obligation to provide a legal notice for the purpose of sending unsolicited advertising and information material. Communication via WhatsApp

To communicate with our customers and other third parties, we use the instant messaging service WhatsApp, among others. The provider is WhatsApp Ireland Limited, 4 Grand Canal Square, Grand Canal Harbour, Dublin 2, Ireland.

Communication takes place via end-to-end encryption (peer-to-peer), which prevents WhatsApp or other third parties from gaining access to the communication content. However, WhatsApp receives access to metadata that is created in the course of the communication process (e.g. sender, recipient and time). We would also like to point out that WhatsApp states that it shares personal data of its users with its parent company Facebook, which is based in the USA. WhatsApp is used on the basis of our legitimate interest in communicating as quickly and effectively as possible with customers, interested parties and other business and contractual partners (Art. 6 para. 1 sentence 1 lit. f GDPR). If a corresponding consent has been requested, the data processing takes place exclusively on the basis of the consent; this can be revoked at any time with effect for the future.

The communication content exchanged between and on WhatsApp will remain with us until you ask us to delete it, revoke your consent to storage or the purpose for data storage no longer applies (e.g. after your request has been processed). Mandatory statutory provisions - in particular retention periods - remain unaffected.

 

5. analysis tools and advertising

Google Ads

The website operator uses Google Ads. Google Ads is an online advertising program of Google Ireland Limited (“Google”), Gordon House, Barrow Street, Dublin 4, Ireland.

Google Ads enables us to display advertisements in the Google search engine or on third-party websites when the user enters certain search terms into Google (keyword targeting). Furthermore, targeted advertisements can be displayed based on the user data available at Google (e.g. location data and interests) (target group targeting). As the website operator, we can evaluate this data quantitatively, for example by analyzing which search terms led to the display of our advertisements and how many advertisements led to corresponding clicks.

The use of Google Ads is based on Art. 6 para. 1 lit. f GDPR. The website operator has a legitimate interest in marketing its service products as effectively as possible.

6 Our presence on social media platforms 

We maintain so-called company accounts or channels on the networks accessible from our website in order to provide you with information and offers within social networks and to offer you further ways to contact us and find out about our offers. In the following, we will inform you about which data we or the respective social network process in connection with your access and use of our company accounts.  

   1. data that we process from you 

If you wish to contact us via Messenger or via direct message via the respective social network, we generally process your user name, which you use to contact us, and may store other data provided by you insofar as this is necessary to process/answer your request. 

The legal basis is Art. 6 para. 1 sentence 1 f) GDPR (processing is necessary for the purposes of the legitimate interests pursued by the controller). 

   

2. (Static) usage data that we receive from the social networks 

We receive automated statistics regarding our accounts via Insights functionalities. The statistics include the total number of page views, likes, information on page activity and post interactions, reach, video views/views and information on the proportion of men/women among our fans/followers. 

The statistics only contain aggregated data that cannot be linked to individual persons. They are not identifiable to us. 

   3. what data the social networks process from you 
 

In order to view the content of our company accounts, you do not have to be a member of the respective social network and no user account is required for the respective social network. 
 

Please note, however, that the social networks also collect and store data from website visitors without a user account (e.g. technical data in order to be able to display the website to you) and use cookies and similar technologies when the respective social network is accessed, over which we have no influence whatsoever. Details on this can be found in the data protection provisions of the respective social network. 

If you wish to interact with the content on our company accounts, e.g. comment on, share or like our posts/contributions and/or wish to contact us via messenger functions, you must first register with the respective social network and provide personal data.  We have no influence on the data processing by the social networks when you use them. To the best of our knowledge, your data is stored and processed in particular in connection with the provision of the services of the respective social network, as well as for the analysis of user behavior (using cookies, pixels/web beacons and similar technologies) on the basis of which advertising based on your interests is displayed both within and outside the respective social network. It cannot be ruled out that your data will also be stored by the social networks outside the EU/EEA and passed on to third parties.  Information on the exact scope and purposes of the processing of your personal data, the storage period/deletion as well as guidelines on the use of cookies and similar technologies in the context of registration and use of the social networks can be found in the data protection provisions/cookie guidelines of the social networks. There you will also find information on your rights and options to object. 

 

7 Audio and video conferencing

Data processing

We use online conferencing tools, among others, to communicate with our customers. The individual tools we use are listed below. If you communicate with us by video or audio conference via the internet, your personal data will be collected and processed by us and the provider of the respective conference tool.

The conferencing tools collect all data that you provide/enter to use the tools (e-mail address and/or your telephone number). The conference tools also process the duration of the conference, the start and end (time) of participation in the conference, the number of participants and other “contextual information” in connection with the communication process (metadata).

Furthermore, the provider of the tool processes all technical data that is required to process the online communication. This includes, in particular, IP addresses, MAC addresses, device IDs, device type, operating system type and version, client version, camera type, microphone or loudspeaker and the type of connection.

If content is exchanged, uploaded or made available in any other way within the tool, this is also stored on the tool provider's servers. Such content includes, in particular, cloud recordings, chat/instant messages, voicemails, uploaded photos and videos, files, whiteboards and other information shared while using the service.

Please note that we do not have full control over the data processing operations of the tools used. Our options are largely determined by the company policy of the respective provider. Further information on data processing by the conference tools can be found in the privacy policies of the tools used, which we have listed below this text. 

 

Purpose and legal basis

The conference tools are used to communicate with prospective or existing contractual partners or to offer certain services to our customers (Art. 6 para. 1 sentence 1 lit. b GDPR). Furthermore, the use of the tools serves the general simplification and acceleration of communication with us or our company (legitimate interest within the meaning of Art. 6 para. 1 lit. f GDPR). If consent has been requested, the tools in question are used on the basis of this consent; consent can be withdrawn at any time with effect for the future. 

 

Storage duration

The data collected directly by us via the video and conference tools will be deleted from our systems as soon as you ask us to delete it, revoke your consent to storage or the purpose for data storage no longer applies. Stored cookies remain on your end device until you delete them. Mandatory statutory retention periods remain unaffected.

We have no influence on the storage period of your data that is stored by the operators of the conference tools for their own purposes. For details, please contact the operators of the conference tools directly.
